Voyage Mobile, Inc., as well as any of its subsidiaries, divisions, or affiliates (“Voyage Mobile,” “we,” or “us”) respects your privacy. This Privacy Policy describes the types of information we may collect from you when you visit www.voyagetext.com or use our applications, products, and services, including our communication tools (collectively, the “Services”). This Privacy Policy also describes how we use the information we collect, with whom we share it, how we protect it, and the choices we offer you regarding our collection and use of such information.

This Policy is expressly incorporated into our Terms of Service. Any dispute between you and us regarding the privacy of your personal information is subject to this Privacy Policy and our Terms of Service, including limitations on damages, resolution of disputes, and application of applicable law.

The Services are marketed for, and directed to, adults or with the consent of adults. Individuals under the age of 18 (or the age of majority in their jurisdiction of residence, if different) are not permitted to use the Services without the supervision of a parent or legal guardian. The Services may use mechanisms to prevent the registration and use of the Services by such underage individuals. Voyage Mobile will never knowingly request, collect, or sell personal information from any child under the age of 18. If you are under 18 years old, please do not provide your information on our Services. Upon notification that a child under the age of 18 has provided us with personal information, we will delete the child’s personal information from our records. Voyage Mobile provides its customers (“Voyage Customers”) with a platform to allow those Voyage Customers to engage with individual consumers (“Consumers,” “you”) via the Services.

1. Information We Collect. We may collect personal information about you, meaning information that can uniquely identify you, from various sources, such as:

  • Directly from our users, both Voyage Customers and Consumers. From our Voyage Customers, we collect account registration information, such as email address, name, and physical address as well as a username and password. From Consumers, we collect the information that is directly provided through our Services, including message history, consents, and any information you send through the Services. We also collect information when you communicate directly to us and our support teams;
  • From our Voyage Customers, who provide us with contact information about their Consumers so that we can facilitate contact through the Services. All Voyage Customers are responsible for providing notice and obtaining appropriate consents necessary for us to process this information;
  • Social networks through which you may access the Services or otherwise interact with us; and
  • Our affiliates, service providers, business partners, and other third parties.

The personal information we may collect about you may include, without limitation:

  • Contact information, such as name, physical address, email address, and phone number;
  • Login information, such as username and password; and
  • Payment and financial details, such as payment card number, expiration date, billing address, and bank account number.

Sensitive Data. We may collect sensitive data, such as account log-ins, financial accounts, debit or credit card numbers, passwords, credentials, or contents of mail, email, or text messages, about you or your household. We take specific business practices to limit the use and disclosure of sensitive personal data, such as:

  • Just-in-time notices at the collection of sensitive data 
  • Requiring your express consent for the collection of sensitive data 
  • Aggregating and/or de-identifying the sensitive data. 

You may direct us to use this sensitive data only for purposes necessary to perform the service or provide the goods that you request from us, with the exception of the following:

  • Collection or processing of sensitive personal data for security purposes;
  • Maintaining/servicing accounts; and 
  • Undertaking activities to verify/maintain the quality of a service 

2. Information We Collect Through Cookies And Other Automated Data Collection Technologies. When you use the Services or the websites of our Voyage Customers that have integrated our Services, we may also collect certain information by automated means, such as cookies. We may also use third-party analytics tools that collect information about use of the Services and user traffic. The information we may collect by automated means may include, without limitation:

  • Information about the devices you use to access the Services (such as the IP address, which may identify your general geographic location, and the type of the device, operating system, and web browser);
  • Dates, times, and duration of use of the Services (including whether you are a repeat or first time visitor); and
  • Information on actions taken when using the Services (such as page views and website navigation patterns).

The information we collect automatically is statistical data and does not include personal information. To the extent that we associate this statistical data with your personal information, we will treat it in accordance with this Privacy Policy. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Services according to your individual interests.
  • Recognize you when you return to our Services.

3. Notice Regarding Cookies, Targeted (Behavioral) Advertising, Profiling, Third-Party Use Of Cookies, Third Party Links And Other Technology

  • Cookies. A cookie is a small file containing a string of characters that may be sent to your web browser when you visit a website. Cookies might be used for the following purposes: (1) to enable certain functions; (2) to provide analytics; (3) to store your preferences; and (4) to enable ad delivery and behavioral advertising. 

Cookies allow us to make our Services more responsive to your needs by delivering a better and more personalized experience to you. We use cookies to identify you as a valid user, to ensure that no one else can sign on simultaneously with your account from another computer and to help us serve you better based on your registration preferences. We may also use cookies to help us facilitate any promotions or surveys that we provide. You can reset your browser to refuse cookies or to indicate when a cookie is being sent. By changing your preferences, you can accept all cookies, you can be notified when a cookie is set, or you can reject all cookies. If you do so and cookies are disabled, you may be required to reenter your information more often and certain features of our Services may be unavailable.

  • Targeted (Behavioral) Advertising. Some content or applications available through the Services, including advertisements, may be served by third parties. These third parties may use cookies to collect information about you when you use the Services, such as your IP address, pages you visit, and when you view a page or open an email in which a tag is embedded. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content and for other purposes. 

Some of the service providers that perform advertising-related services for third parties may participate in the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Program for Online Behavioural Advertising.   • Profiling. We may also partner with third-party service providers to engage in “profiling” which is defined as “any form of automated processing performed on personal data to evaluate, analyze, or predict personal aspects related to an identified or identifiable natural person’s economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.”
  • Third-Party Use of Cookies. We do not control these third parties’ tracking technologies or how they may be used. The information practices of these third parties are governed by their own privacy policies and are not covered by this Privacy Policy. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
  • Third Party Links. The Services may include social media features and links, and may use social media application programming interfaces (“APIs”) for log-in. The social networking site may collect certain personal information about you and you may allow us to have access to certain personal information associated with your social media account (e.g., name, username, email address, profile picture) in order to provide the feature. Please see the privacy policy for the applicable social networking website to learn more about how these social networking websites share your personal information, which practices may differ from ours.
  • Do Not Track Signals. Your web browser may let you choose your preference as to whether you want to allow the collection of information about your online activities over time and across different websites or online services. The Services do not respond to the preferences you may have set in your web browser regarding such collection of your information, and the Services may continue to collect information in the manner described in this Privacy Policy. 4. How We Use The Information We Collect. We may use information we obtain about you to:

  • Communicate with you through the Services, including sending email addresses, push notifications or text messages;
  • Process orders you place and complete other transactions you have requested using the Services, and provide you with products and services you request;
  • Send you information or materials you request;
  • Maintain a record of your purchases and other transactions using the Services;
  • Respond to your questions and comments and provide customer support;
  • Communicate with you about our products, services, offers, and promotions, subject to your prior opt-in consent if required by applicable law;
  • Operate, evaluate, and improve our business and the products and services we offer;
  • Analyze and enhance our marketing communications and strategies;
  • Analyze trends and statistics regarding use of the Services and transactions conducted using the Services;
  • Protect against and prevent fraud, unauthorized transactions, claims, and other liabilities, and manage risk exposure, including by identifying potential hackers and other unauthorized users;
  • Enforce our Terms of Use and other agreements;
  • Comply with applicable legal requirements and industry standards;
  • For our legitimate interests or those of a third party; or 
  • In any other way we may describe when you provide the information or for any other purpose with your consent. 

A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.

5. Disclosure Of Information. We may disclose aggregated information about our users, and information that does not identify any individual user, without restriction. We may disclose personal information about you to the following categories of third parties:

  • If you are a Consumer, we may share your information, such as your message history, with the Voyage Customer you are communicating with;
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce or apply our Terms of Use and other agreements;
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Voyage Mobile, users of the Services, or others; and
  • Otherwise with your consent.

We also reserve the right to transfer your personal information to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets. Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use your personal information in a manner that is consistent with our Privacy Policy.

6. Your Choices. We offer you the following choices about the information we collect from you and how we communicate with you:

  • Cookies. Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all of the features of the Services. 
  • Promotional Communications From Voyage Customers. You can opt out of receiving future promotional emails sent from our Voyage Customers via our Services by following the unsubscribe instructions contained in such email or by contacting us as directed below. You can opt out of receiving further commercial text messages sent from our Voyage Customers via our Services by responding to any Voyage Mobile-generated text message with the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.
  • Promotional Communications From Voyage Mobile. If you have received a promotional email from us, you can opt out of receiving future promotional emails from us by following the unsubscribe instructions contained in such email or by contacting us as directed below.
  • Targeted (Behavioral) Advertising and Tracking. Although we do not control third parties’ collection or use of your information to serve interest-based advertising or other targeted content, a number of these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted advertisements from members of the Network Advertising Initiative by visiting http://www.networkadvertising.org/choices. To successfully opt out, you must have cookies enabled in your web browser (see your browser’s instructions for information on cookies and how to enable them). Your opt-out only applies to the web browser you use so you must opt-out of each web browser on each computer you use. Once you opt out, if you delete your browser’s saved cookies, you will need to opt-out again. Please note this does not opt you out of being served advertisements. You will continue to receive generic advertisements.
  • Profiling. You may opt out of our use of your personal information for the purposes of profiling by contacting us in one of the methods described in the “How to Contact Us” section. 
  • Sensitive Data. You may opt out of our collection of sensitive data or direct us to use your sensitive data only for purposes necessary to perform the service that you request from us, by contacting us in one of the methods described in the “How to Contact Us” section. 
  • Geolocation Information. You may opt out of our collection of your precise geolocation information by contacting us in one of the methods described in the “How to Contact Us” section. 

7. Accessing And Correcting Your Information. If you have an account with us, you can access, review and correct certain personal information associated with your account through your account settings.

8. Your California Privacy Rights. California Civil Code Section § 1798.83 permits users of our Services who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Code § 59.1; the Colorado Privacy Act, Colo. Rev. Stat. § 6-1-1300; the Utah Consumer Privacy Act; and the Nevada Security and Privacy of Personal Information Act, NRS § 603A.010, as applicable. 10. Canadian Rights Under PIPEDA. If you are a citizen of Canada, in addition to the rights described within, you are entitled to the following rights under the Personal Information Protection and Electronic Documents Act:

  • Accessing and Correcting Your Personal Information. By law, you have the right to request access to and to correct the personal information that we hold about you. If you want to review, verify, correct, or withdraw consent to the use of your personal information, you may send us an email at service@voyagesms.com  to request access to, correct, or delete any personal information that you have provided to us.
  • Withdrawing Your Consent. Where you have provided your consent to the collection, use, and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances, including the following:
  • Targeted (behavioral) advertising as described above
  • Marketing communications 
  • Cookies, Geolocation, IP address or other tracking technology as described above
  • Retention of personal information 

To withdraw your consent, if applicable, contact us as described below in “How to Contact Us.” Please note that if you withdraw your consent we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you with your decision.

11. Changes To Our Privacy Policy. Voyage Mobile reserves the right to update or change this Privacy Policy at any time. If we make a material change to our Privacy Policy, we will provide notice to you (by email and/or posting on our website or Services) that our privacy practices have changed and will provide a link to the new policy. In the event we make a material change to how we use your personal information, we will request your express consent and/or provide you with an opportunity to opt out of such new or different use. The date this Privacy Policy was last revised is at the top of this page. We encourage you to review this Privacy Policy periodically to check for any updates or changes.

12. About Our Data Practices.  

  • Data Retention. Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. 
  • Data Security. We have implemented measures intended to protect your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. Please note that the electronic transmission of information is not completely secure. We cannot guarantee that the security measures we have in place to safeguard personal information will never be defeated or fail, or that such measures will always be sufficient or effective. Any transmission of personal information is at your own risk.
  • Data Transfers. Voyage Mobile is based in the State of California in the United States. When we obtain information about you, we may transfer, process, and store such information outside of the country in which you reside, including in the United States. By using the Services, you consent to the transfer to and processing and storage of your information in countries outside of your country of residence, which may have different data protection laws than those in the country where you reside. The Services are not intended for or provided to Voyage Customers or Consumers in the European Union.
